Terms and Condition

These terms and conditions of sale are entered into by My Dubai Adventure, a brand of the Marche Company fzco, whose registered office is located at Dubai Silicon Oasis in Dubai, and by any individual or legal entity wishing to make a purchase via the www.mydubaiadventure.com website, hereinafter referred to as “the buyer”.

Article 1. PURPOSE

The purpose of these terms and conditions of sale is to define the contractual relationship between My Dubai Adventure and the buyer and the terms and conditions applicable to any purchase made through the www.mydubaiadventure.com website. The purchase of a product through this website implies the buyer’s unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Prior to any transaction, the purchaser declares that the purchase of products on the www.mydubaiadventure.com website is not directly related to his/her professional activity and is limited to strictly personal use, and that he/she has full legal capacity to enter into a commitment under these terms and conditions of sale. My Dubai Adventure reserves the right to modify these terms and conditions at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. SERVICES

The services offered are those listed on the www.mydubaiadventure.com website, subject to availability. My Dubai Adventure reserves the right to modify the activities, their content and prices at any time. Each service is presented on the website in the form of a description of its main characteristics. The photographs are as accurate as possible but are not binding on My Dubai Adventure. The sale of the activities presented on the www.mydubaiadventure.com website is intended for all purchasers who are in the Emirates or who wish to travel there.

Article 3. RATES

The prices of the products are indicated in UAE dirhams (AED) excluding tax (HT). The legal UAE VAT rate of 5% is applied to this price. My Dubai Adventure reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer.

Article 4. ORDERING AND PAYMENT METHODS

Before placing an order, the buyer must provide all the information necessary for processing, i.e. surname, first name, email, Whatsapp number, hotel (with precise name) or address on the website www.mydubaiadventure.com. All of this information must be filled in at the end of the order process when the shopping basket is validated. My Dubai Adventure offers the buyer the possibility to order and pay for their activities by secure credit card payment (via the Stripe secure payment processor): the buyer selects the activities they wish to order in the “shopping basket”, modifies if necessary (quantities,…), checks their details (name, first name, hotel/address, Whatsapp number…). Then, the buyer proceeds to the payment. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to validate the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the secure interface in order to enter his personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card account is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. In order to obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest the debit in writing to his/her bank as soon as possible. The amounts debited will be reimbursed by the bank within a maximum period of one month after receipt of the written contesting by the cardholder. The holder shall not be charged any costs for the return of the sums. Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke one’s own terms and conditions of purchase. All the data provided and the recorded confirmation shall be considered proof of the transaction. If the purchaser has an e-mail address and has provided it on the order form, My Dubai Adventure will send the purchaser an e-mail confirming that the order has been registered. Article 5. INDEMNIFICATION

Our company is an intermediary between you and the suppliers/service providers. You are responsible for any possible material or physical damage. You therefore agree to indemnify our company, its subsidiary(ies), subcontractors, suppliers, employees and trainees, service providers, in particular against any claims or demands (including legal fees and proceedings) made by any third party during, before and after the performance of any service(s) but also in case of violation of the terms of sale, the law in force in the United Arab Emirates or the rights of any third party.

Article 6. WITHDRAWAL

The right of withdrawal cannot be exercised for “leisure activities provided on a specific date”.

Article 7. DELIVERY

We reserve the right to update, modify or replace any part of these Terms and Conditions of Sale and Use by posting updates and modifications on our website. It is your responsibility to check our website regularly for changes.

Article 8. LIABILITY AND EXCLUSION OF WARRANTY

My Dubai Adventure and all members of its team shall not be liable for any personal injury, property damage, indirect and/or consequential loss, claim, breach of statutory law, including but not limited to loss of profit/revenue/data resulting from the provision of any services through us. We endeavour to provide you with the best possible service but we do not guarantee that the service will be uninterrupted, secure or error free. You accept that from time to time the service may be interrupted for an indeterminate period or cancelled without prior notice to you.My Dubai Adventure, in the process of distance selling, is only bound by an obligation of means. My Dubai Adventure cannot be held responsible for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, disruption of service, or other involuntary problems.

Article 9. INTELLECTUAL PROPERTY

All elements of the www.mydubaiadventure.com website are and remain the exclusive intellectual property of My Dubai Adventure. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals or text.

Article 10. PERSONAL DATA

My Dubai Adventure undertakes to maintain the confidentiality of any information provided by the buyer, which he/she may be required to transmit in order to use certain services.
